Official Rules for Polarity Leads’ Mobile App Drawing
Eligibility: Open to local brick-and-mortar businesses with a physical location in the United States. E-commerce businesses (e.g., Shopify, WooCommerce, BigCommerce, Etsy, eBay, etc.) are not eligible. Entrants must be 18 years or older and authorized to represent the business.
Sponsor: This drawing is sponsored by Polarity Leads, located in Chandler, Arizona, United States.
Entry Period: The drawing begins on January 1, 2025, and ends on January 27, 2025, at 11:59 PM ET.
How to Enter: Complete the entry form on the Polarity Leads website. Limit one entry per business.
Prize: One winner will receive a custom mobile app build based on their existing website theme and functionality, valued at $5,300.00. The prize includes 4 hours of marketing assistance to promote the new app.
Monthly Fee and Acceptance: The winner agrees to pay a $99.00 monthly network maintenance/service/Push Notification fee, including two monthly app updates and unlimited Push Notifications. If the winner does not agree to this fee, they will be disqualified, and a runner-up will be awarded the mobile application build.
Website Requirement: If the winner does not have a public website, they agree to have one up and live within 45 days of winning to serve as the basis for the mobile app.
Winner Selection: One winner will be randomly selected from all eligible entries on January 28, 2025, at 8 PM ET.
Notification: The winner will be announced on https://polarityleads.com/mobile-app-winner NLT 1/30/2025, and the winner will be contacted directly.
Consent: By entering, participants agree to receive marketing communications from Polarity Leads. In compliance with the FCC's 2025 lead generation rules, this consent is specific to Polarity Leads and is not transferable to other sellers.
Publicity: The winner agrees to the use of their business name and likeness for promotional purposes without additional compensation.
General Conditions: Polarity Leads reserves the right to cancel, suspend, or modify the drawing if fraud or technical failures compromise its integrity.
Disclaimer: By participating, entrants agree to release Polarity Leads and its affiliates from any liability associated with this drawing.
Void Where Prohibited: This drawing is void where prohibited by law.
Hold Harmless and Liability Disclaimer: By entering this drawing and accepting the prize if selected as the winner, the participant agrees to defend, indemnify, and hold harmless Polarity Leads, its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:
a. The participant's use of and access to the mobile application
b. The participant's violation of any term of these Official Rules
c. The participant's violation of any third party right, including without limitation any copyright, property, or privacy right
d. Any claim that the participant's use of the mobile application caused damage to a third party. This defense and indemnification obligation will survive the termination of this agreement and the participant's use of the mobile application.
No Guarantee of Income or Increased Business: Polarity Leads makes no promises or guarantees regarding income, revenue, or increased business through the use of the mobile application. The success of the application in generating business or income depends on various factors, including but not limited to the participant's marketing efforts, business model, and market conditions. The mobile application is provided as a tool, and its effectiveness may vary based on individual circumstances.
Modification Clause: Polarity Leads reserves the right to modify, suspend, cancel, or terminate the drawing at any time for any reason, including if fraud, technical failures, or any other factor beyond Polarity Leads' control impairs the integrity or proper functioning of the drawing.
Disqualification Clause: Polarity Leads reserves the right to disqualify any entrant who tampers with the entry process, violates the rules or acts in an unsportsmanlike or disruptive manner.
"As Is" Prize Clause: The mobile app is awarded "as is" with no warranty or guarantee, either express or implied, by Polarity Leads.
Dispute Resolution: Any disputes related to this drawing shall be resolved individually, without resort to any form of class action, and exclusively by a court located in Arizona, having jurisdiction.
Publicity Release: By accepting the prize, the winner grants Polarity Leads the right to use their name, likeness, and business information for advertising and promotional purposes without additional compensation.
Compliance with Laws: The drawing is subject to all applicable federal, state, and local laws and regulations.
Limitation of Liability: Polarity Leads is not responsible for: (1) any incorrect or inaccurate information; (2) technical failures of any kind; (3) unauthorized human intervention in any part of the process; (4) any damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the drawing.
Intellectual Property Rights: Polarity Leads retains all rights to any materials, data, or information developed for or resulting from the mobile app development.
Force Majeure: Polarity Leads shall not be held responsible for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control.
Waiver of Damages: By participating in this drawing, contestants agree that they will not seek damages of any kind from Polarity Leads, whether they win or lose the drawing. This includes but is not limited to, actual, incidental, consequential, or punitive damages. Contestants' sole remedy, if any, is limited to the prize awarded in accordance with these Official Rules.
Limitation of Liability: Under no circumstances will the contestant be permitted to obtain awards for, and the contestant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of contestants and Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the substantive laws of the State of Arizona, USA. By entering this drawing, participants acknowledge that they have read, understood, and agreed to these terms and conditions.
The winner must reply with acceptance of the winning (free mobile application build-out) within 14 days of being notified by email or phone message/conversation. If the winner does not accept the winning free mobile application another drawing will be performed and another winner will be selected.
